Who we are

PointFactors is a point-factor job-evaluation and compensation platform provided by Playita Ventures LLC ("PointFactors," "we," "us," or "our"). This Privacy Policy explains how we collect, use, share, and protect personal information across the PointFactors website at pointfactors.com and the PointFactors platform, including any free version (together, the "Services"), and the rights you may have.

Information we collect

  • Information you provide. When you create an account, request a demo, submit a contact or referral-program form, or correspond with us, we collect details such as your name, work email, company, job title, website, and the contents of your message.
  • Customer Data you submit to the platform. When you use the platform, you may upload job descriptions, job and role information, evaluation inputs, and related data ("Customer Data"). You control what you submit. If Customer Data includes information about your employees or other individuals, you are responsible for having a lawful basis and providing any required notices to them.
  • Payment and transaction information. If you make or receive payments (for example, under the referral program or a paid plan), our payment processor (Stripe) handles card and payout details; we receive transaction metadata but not your full payment card number.
  • Usage and device information. We use privacy-focused web analytics to understand aggregate usage such as pages visited, referring sources, and general device/browser information. We and our providers may use cookies or similar technologies as described below.

Customer Data and your role

For personal information contained in Customer Data that you submit about your own employees or other individuals, you act as the data controller (or business) and we act as your service provider/processor, handling that information on your behalf and per your instructions and any applicable agreement between us. If you are an individual whose information was submitted to the platform by an employer or another organization, please direct privacy requests to that organization; we will support them in responding.

How we use information

  • To provide, operate, secure, maintain, and improve the Services;
  • To create and administer accounts and respond to your inquiries and demo requests;
  • To review referral-program applications and administer the program, including issuing codes and calculating commissions;
  • To process payments and prevent fraud and abuse;
  • To send service and, where permitted, marketing communications (you can opt out at any time); and
  • To comply with legal obligations and enforce our terms.

Legal bases (EEA/UK)

If you are in the European Economic Area or the United Kingdom, we process personal information where necessary to perform a contract with you, in our legitimate interests (such as operating, securing, and improving the Services), to comply with a legal obligation, or based on your consent (which you may withdraw at any time).

Cookies and analytics

We use essential cookies needed to run the Services and privacy-focused analytics to measure aggregate usage. You can control cookies through your browser settings; disabling some cookies may affect functionality. We do not use cookies to sell your personal information or for cross-context behavioral advertising.

How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with service providers ("subprocessors") who help us run the Services — for example, hosting (Vercel), database infrastructure (Supabase), email delivery (Resend), payments (Stripe), scheduling (Calendly), and AI processing (OpenAI) — each bound to use it only to provide their service. Where you use AI-assisted features of the platform, the inputs you submit are processed by OpenAI as our service provider to generate results. We may also disclose information to comply with law or protect rights and safety, or in connection with a merger, acquisition, or sale of assets, in which case we will seek to ensure the information remains protected.

International data transfers

We are based in the United States and our providers may process information in the United States and other countries. Where we transfer personal information from the EEA, UK, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.

Data retention

We retain personal information for as long as needed to provide the Services, maintain your account, comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or anonymize it. We retain and delete Customer Data in accordance with your instructions and any applicable agreement.

Security

We use industry-standard safeguards — including encrypted transport, access controls, and reputable infrastructure providers — to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy (portability) of your personal information, and to object to or restrict certain processing or withdraw consent. To exercise any of these rights, contact us at info@pointfactors.com. We will not discriminate against you for exercising your rights.

EEA/UK residents may also lodge a complaint with their local data protection authority. California and other U.S. state residents may have rights to know, access, delete, and correct their personal information and to opt out of "sale" or "sharing" — note that we do not sell or share personal information as those terms are defined. Where a request concerns Customer Data submitted by an organization, we will refer you to that organization.

Children's privacy

The Services are intended for businesses and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will delete it.

Third-party links

Our Services may link to third-party websites and services (such as scheduling or payment providers). We are not responsible for their privacy practices, and we encourage you to review their policies.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
